PARIS (June 9, 2016) –International law firm McDermott Will & Emery advised biopharmaceutical company DBV Technologies on its global collaboration agreement with Nestlé Health Science to develop and commercialize MAG1C, an innovative patch-test for the diagnosis of Cow’s Milk allergy (CMPA) in infants and toddlers. The new diagnostic test is expected to be submitted for approval to regulatory authorities worldwide by 2021.
Under the terms of the agreement, which closed on 1 June 2016, DBV will be eligible to receive up to €100 million in development, registration and commercial milestones, including an upfront payment of €10 million. DBV will be responsible for performing development activities through a pivotal clinical program, following which Nestlé Health Science has the exclusive right to commercialize the product globally.
