McDermott’s Healthcare Litigation, Compliance & Investigations Forum Explores Risks Healthcare Providers Face

Overview

Leading health law firm McDermott Will & Emery is hosting its fourth annual Healthcare Litigation, Compliance & Investigations Forum in Washington D.C. on Tuesday, November 5, 2019, at the Conrad Hotel. The full-day Forum will feature nearly 30 leaders providing unique insights into the always-developing areas of government investigations, litigation and risk compliance.

“This really is a must-attend event and these sessions—featuring some of the leading authorities on today’s compliance and regulatory environment—are specifically designed to keep our clients one step ahead of change and better equip them to navigate the regulatory landscape,” said David Rosenbloom, co-chair of the Forum and global co-chair of McDermott’s Litigation Practice.

The agenda features two keynote speakers:

  • Daniel R. Levinson is giving the morning address. For the last 15 years, Dan Levinson led the Office of Inspector General (OIG) of the U.S. Department of Health and Human Services (HHS). This top federal health fraud enforcer and policymaker will be providing participants with unique insights into the government’s view and strategy for combatting health care fraud.
  • Dr. Ezekiel Emanuel, the luncheon keynote speaker, is a former White House special advisor for health policy from 2009-2011, and had a significant impact on federal healthcare budgets and the Affordable Care Act. Currently, Dr. Emanuel is the Vice Provost for Global Initiatives and Chair of the Department of Medical Ethics and Health Policy at the University of Pennsylvania.

Panel topics include:

  • Inside the Beltway – What Changes in Washington Mean for Your Business – Examining recent developments and the regulatory agenda in the courts and agencies.
  • Why Bad Things Can Happen to Companies with Good Compliance Plans: Important Lessons Learned the Hard Way – What makes the government target companies and how to create a culture of compliance that allows companies to institute a culture that goes beyond its formal compliance programs.
  • Private Equity under the Microscope: A New Wave of Healthcare Enforcement – Emerging enforcement trends and how healthcare investors can insulate themselves from potential exposure.
  • Big Changes to Stark and Anti-Kickback – Fresh off the heels of the government’s recent proposals that may dramatically change the industry, this panel explains what this means for structuring compliance programs today.
  • Virtual Healthcare: Navigating Risk – Exploring how compliance programs can effectively identify, assess and manage risks in a way that supports continued innovation in virtual healthcare delivery.
  • Commercial Litigation in the Healthcare Space, including Best Practices for Handling Disputes with Physicians – Navigating disputes with provider groups in the highly regulated healthcare industry, including critical issues relating to enforcement of non-compete and non-solicitation provisions and post-acquisition litigation.
  • Avoid Creating the Whistleblower: Best Practices to Handle Complex Employee Situations – This panel will discuss strategies for the delicate balancing act of containing and addressing issues in ways that make it more likely that employees will want to be a part of the solution.

“It’s not enough to be current in today’s regulatory environment. The best leaders are investing to understand and anticipate what’s next – and that’s who we designed this event for,” said Eric Zimmerman, co-chair of the Forum and chair of McDermott’s Healthcare practice.
