McDermott’s Representation of Monsanto Recognized in CVN’s “Top 10 Defense Verdicts of 2016”

February 3, 2017 – McDermott has been recognized by Courtroom View Network (CVN) for achieving one of the “Top 10 Defense Verdicts of 2016.” The McDermott team, led by Anthony Upshaw, was awarded with the number two ranking on the list for its defense of Monsanto in the case Dauber v. Monsanto.

The case turned on the alleged health risks of the plaintiffs’ exposure to polychlorinated biphenyls (PCBs) in the environment.

Monsanto argued that no link has been made between PCBs and non-Hodgkin’s lymphoma, and that actions taken by the company as far back as the 1930s must not be measured against the environmental standards in place today, but that even then, Monsanto’s conduct decades ago complied with today’s standard of care.

On April 5, 2016, a 12-member jury in the Superior Court of California for Los Angeles County cleared Monsanto of liability for the plaintiffs’ illnesses – the third time this result had been reached for the client.

In compiling its Top 10, CVN looked beyond the potential amount of damages, and took into account the facts of the case, parties involved, attorneys involved, and the potential broader impact of the verdict.
