Kristin Michaels said that, even if the NLRB in the Trump Administration is not “aligned with the pro-union agenda of the current majority” of the board, unless it sets aside or limits the “microunit” labor organizing rights established in its Specialty Healthcare ruling “employers concerned about possible microunit organizing should familiarize management on microunits and how the NLRB determines the appropriateness of [them] and take steps to position their company to challenge proposed microunits.”
