Anthony Upshaw told a California court that plaintiffs accusing a global agribusiness company of failing to properly test a chemical which they allege caused their cancer were applying today’s standards to exposure from decades ago. To compare his client “to our standards of today would be unfair,” Mr. Upshaw said. “We have to compare [the company] to what was happening at the time the event occurred.”
