James Pardo said that any court challenges to New York State’s new fracking ban would likely face an uphill battle, given the comprehensiveness of the ban and the time taken to implement it. Even so, he continued, challenges are inevitable because “if this is the approach the … governor is going to take, I can’t imagine an energy project that could possibly go forward in the state of New York, if you really lifted the covering and did a worst case scenario analysis.”
