Arthur Rosen, addressing a New York court’s denial of a major telecom company’s effort to dismiss a sales and use tax case brought under the False Claims Act, said he was “extremely disappointed by the court’s avoidance of any discussion of when it is appropriate to circumvent normal government procedures by using the FCA.” Mr. Rosen wrote an amicus brief in the case for the Council On State Taxation.
