Joanne Ludovici predicted that “we’re going to see brand battles” with the easing of restrictions on trade with Cuba, and urged that “companies need to file for protection now” on their trademarks. Because there is a first-to-file aspect that allows trademark applicants to win protection by showing an intent to use a brand in U.S. commerce, “there is going to be a jockeying for position at the PTO” on such filings, Ms. Ludovici added.
