Jeremy Earl said that, even if there is no legislation to implement the 2017 HHS budget proposal, the CMS could still implement a plan in the proposal giving it authority to mandate that states recoup funds when a Medicaid MCO fails to meet a suggested minimum loss ratio (MLR), because it falls short of making states impose a binding MLR requirement.
