Nick Holland spoke to Solicitors Journal about the latest news confirmed by the Law Society of England that UK law firm LLPs will not need to restructure in order to continue practicing in France from January 2021. Nick welcomed the news, yet warned that there are still significant remaining issues, particularly the enforceability of English judgments and whether UK lawyers will enjoy privilege in the EU post Brexit.
“As things currently stand, the UK will cease to enjoy the benefits of the recast Brussels Regulation and the Lugano Convention on Jurisdiction and Enforcement of Foreign Judgments in respect of the enforceability of UK court judgments, as well as EU legal professional privilege.”
