Jon Dubrow described an FTC/DoJ commitment to consult the Defense Department on antitrust evaluations of defense company mergers as not “much of a change” because the regulators “made it clear they were retaining authority to review defense transactions on antitrust grounds.” He added, however, that DoD “got a public reaffirmation that its views are important in the antitrust review process, including its views relating to the impact of transactions on national security.”
