Jeffrey Brennan, Ashley Fischer, Carrie Amezcua, David Marx Jr., Stephen Wu, James Camden, Douglas Litvack and Michelle Lowery were co-authors of this article summarizing federal antitrust regulators’ policies toward the healthcare sector. The authors wrote that under these policies, “The Affordable Care Act and the antitrust laws are fully aligned in promoting … the principles of market competition,” meaning the ACA is not “a green light for anti-competitive consolidation and conduct among health care market participants.” The authors thus urged such participants to analyze every consolidation “under the traditional framework of antitrust law.”
