Stephen Kranz commented about the Sixth Circuit’s rejection of South Dakota’s remote sales tax law that “South Dakota has said it would consent to rulings against it” because that “could allow the state to petition for cert by the end of November” asking the Supreme Court to review the ruling and possibly overturn the Quill decision which justified it. He added that, if Judge Neil Gorsuch is added to the Court, it may be open to reexamining Quill.
