Anthony Bongiorno predicted that anticipated 2015 Third and Eleventh Circuit rulings on two cases challenging the FTC’s authority to regulate data security under Section 5 of the FTC Act have “the potential to be a game changer for the FTC’s enforcement authority. A loss for the FTC would represent a seismic change in the data security landscape.”
