Proposed Regulations on Excepted Benefits Provide Guidelines, But Employers Should Watch for Final Rules, Expert Says

Joanna Kerpen said that new federal regulations defining Affordable Care Act exemptions for limited excepted health benefits “were needed to clarify the existing rules regarding limited coverage plans that qualify as excepted benefits, to set forth when an employee assistance plan (EAP) qualifies as an excepted benefit, and to allow employers to supplement Exchange coverage purchased by employees … with “wraparound” coverage that qualifies as an excepted benefit.” She urged employers to “watch for final regulations on this issue, as the proposed regulations ask for comments on several points.”
