Sabine Konrad, who is one of four German arbitrators at the International Centre for Settlement of Investment Disputes, discussed how investor-state arbitration helps companies seek compensation against arbitrary government intervention. “Arbitration courts are important guarantors of international law,” Ms. Konrad said, noting that they offer participants “neutral, independent judicial action against unlawful interference, without having to rely on the political support of the home country. It is about justice and fairness.”
