Sandra DiVarco said that, when emergency room doctors comply with the legal requirements for referring patients to another site, if a bad outcome occurs afterward, the patient may still file a complaint. “This means that there could be survey activity all the way through to civil monetary penalties if a violation is found,” Ms. DiVarco warned, adding that even if the referring doctor is found not liable, “at the end of the day, it could be a long and expensive road to get to that conclusion.”
