Rule Prohibiting LGBT Discrimination Requires Some Contractor Action

Todd Solomon explained that, under new Department of Labor rules which prohibit federal contractors from discriminating based on sexual orientation or gender identity, “Federal contractors will need to update their nondiscrimination policies to include sexual orientation and gender identity and will be prohibited from discriminating on these bases, even though federal law currently does not ban such discrimination.” He added that contractors may “be required to offer benefits, such as medical benefits, to same-sex spouses because failure to do so would likely constitute discrimination based on sexual orientation.”
