Jeffrey Brennan warned that “if states do not have an active supervision structure in place” for state professional regulatory boards, then the decisions of those boards “will be very vulnerable to challenges” in light of a Supreme Court ruling that a North Carolina dental illegally suppressed competition because North Carolina didn’t actively supervise the board’s actions.
