Ankur Goel, along with John Walker, represented more than 60 rural hospitals that asked the District of Columbia Circuit Court to require the Department of Health and Human Services and its Secretary to recalculate Medicare payouts that allegedly shortchanged reimbursements to the hospitals in violation of congressional budget shields. “The [HHS] secretary has not paid the target amount defined by the statute … [and] concedes that she did not adjust the weighting factors in order to be budget neutral,” Mr. Goel told the court. “If the secretary had simply done so, there would be no issue here.”
