Todd Solomon suggested that domestic partnership benefits programs limited to same-sex couples may no longer stand up in court following the Supreme Court’s Obergefell ruling because an opposite-sex couple could sue to claim the benefit. “It is a much more viable claim,” now that same-sex marriage is legal nationwide Mr. Solomon said, but employers that offer domestic partner benefits to both opposite- and same-sex couples might not make any changes.
