Chris Scheithauer called the use of independent contractors “an unsettled area of law, and if you’re a big company wishing to make widespread use of independent contractors, you are likely going to be sued and tested, and the outcome may be unclear at this point, depending on the facts.” Given the potential costs, Mr. Scheithauer added, “it may not be worth it to utilize those independent contractors.”
