Mark Pearlstein, representing before the First Circuit an investment executive who is appealing SEC sanctions over alleged misleading statements about investments, said that “it defies logic to think the institutional investors here could have been misled by that expression of belief that is clearly protected by the Omnicare case” decided by the Supreme Court. Also representing the executive are Fredric Firestone, Laura McLane and David Chen.
