Solicitor General Tells High Court Not to Hear Case Involving Vermont Health-Care Database

Miller Baker were among the lawyers who filed a pro bono brief with the Supreme Court on behalf of a major insurer, The brief supports the Second Circuit’s decision that the Vermont Health Care Uniform Reporting and Evaluation System (VHCURES) is ERISA-preempted, arguing that the requirements imposed by VHCURES “fall squarely within the realm” that Congress reserved for ERISA plans.
