Diann Smith said the Supreme Court’s appointment of a special master to handle state unclaimed property lawsuits against Delaware is common for a case in which there have been no prior lower court decisions. “Because it’s a case between states,” the Supreme Court is “not really set up” to act as trial court in the matter, Ms. Smith continued; instead the special master will act as a trial court would and make recommendation on the case to the Supreme Court.
