Stephen Kranz, noting the many state efforts to challenge the Quill physical presence standard for applying sales tax, said that “states appear to have largely given up on congressional action” to resolve the issue. Since “the legislative intent no longer appears focused on messaging Congress,” he continued, “it appears that there is a serious effort to pass laws at the state level, forcing remote sellers to begin collecting or face the risk of liability.”
