Todd Solomon, while noting that case law should continue to reflect strong support for same-gender marriage, said that a split among the circuit courts may lead the Supreme Court to hear the issue and resolve whether states can continue to deny same-gender marriages. “This is something folks hoped the Supreme Court would have taken up before,” Mr. Solomon added. “A favorable ruling — from the same-sex marriage perspective — would be very significant from a benefits standpoint because it would help standardize things.”
