Joshua Rogaczewski said that a case now before the US Supreme Court, which deals with whether meeting an individual’s claims renders a class action lawsuit moot before it receives class certification, involves a strategy that “is going to remain viable” because it “effectively cut off the class action” and “nips the case in the bud…. If [you] offer the plaintiff everything [they are] entitled to, is there anything left worth fighting about?”
