Mark Pearlstein, a member of the McDermott team representing Universal Health Services before the US Supreme Court, said the Court’s ruling expressly disagreed with the First Circuit’s expansive view of Fair Claims Act liability in the case and thus remanded the case back to the First Circuit to review it “under the new, rigorous standard of materiality stated by the Supreme Court.” Mr. Pearlstein added, “My client looks forward to litigating the case on remand and is confident of prevailing under the new Supreme Court standard.’’
