Supreme Court to Hear Arguments Over Whether Arbitration Act Exemption Applies to Transportation Contractors

Ron Holland discussed the U.S. Supreme Court case Oliveira v. New Prime Inc., which addresses whether an exemption to the Federal Arbitration Act applies to independent contractors. Referring to the plaintiff’s interpretation of the exemption, he said that “It seems to be a stretch. That part of the analysis [by the 1st Circuit] is inconsistent with almost every other court that has considered the issue. I think the plain language approach is appropriate here.”
