Tax Court Orders Discovery of Government’s Nonparty Subpoenas

M. Todd Welty said a Tax Court order that the IRS produce nonparty subpoenas “is entirely consistent with long-established policy to avoid trial by ambush in civil matters.” Mr. Welty added that he was pleased there is now a Tax Court pronouncement on the matter, even if it is technically non-precedential.
