Fabio Marino, speaking of major technology companies and their allies, said “the fervor is less vocal, but they are still pushing” for congressional passage of The Innovation Act patent reform bill. In patent litigation, Mr. Marino said he hasn’t seen much impact from the twin rulings on fee-shifting in Octane Fitness and Highmark, which handed district judges more discretion. “There have been a lot of people threatening sanctions, and that has some bite to it, but in terms of cases where sanctions have been awarded, they are few and far between,” he noted.
