Ahsan Shaikh said the Federal Circuit’s McRO case, which involves software patent claims for lip-sync animation technology, is important for putting back into play the ability of patents to preempt described techniques and for addressing whether individual features of patent claims can be singled out from the overall idea. “These are subtle points, but they’re really helpful because they’re opening more and more doors for software tech companies,” Mr. Shaikh added.
