Jay Reiziss, who represents clients in IP disputes before the International Trade Commission, said about that body’s enforcement power, “I joke with prospective clients and say, ‘folks, people with guns are going to be enforcing the injunction.’” Paul Devinsky, who also practices before the ITC, agreed that, “If I’m a complainant and I have effectively an injunction, then, as a respondent, if I want to stay in this market, I’m going to have to make some kind of settlement.”
