Lauren Ferrante agreed with the dissenting judges in a 4-3 Virginia Supreme Court ruling to limit safe harbors on taxation of royalty payments by a company to an affiliate. “As the dissent correctly points out, this court really goes to great lengths to land a principle of statutory interpretation that supports the result that it wants [and] discard without much analysis the principles of statutory interpretation that are inconsistent with the result that it wants,” Ms. Ferrante said.
