Diann Smith and Stephen Kranz criticized the Tennessee Supreme Court Vodafone ruling on tax apportionment. Ms. Smith said the decision “did not explain exactly what the benchmark is for determining whether a business’s activity in a state is fairly reflected by the standard apportionment formula,” while Mr. Kranz added, “I just can’t bring myself to believe that the legislators who were originally asked to consider and adopt the alternate apportionment language intended it to be used in the manner it is.”
