Joanne Ludovici said that a Federal Circuit ruling which held (in light of a recent Supreme Court decision) that federal reviewers were wrong to deny trademark protection to vulgar language used on clothing is likely to be the last word on scandalous and immoral trademarks because “it means that the USPTO will not likely seek Supreme Court review.”
