Eugene Goldman assessed the forthcoming Second Circuit U.S. v. Newman et al. case regarding insider trading, saying that it “has the potential of imposing on the government the burden of showing that a tippee was aware that the tipper, much further down the line, disclosed information for personal gain. That could ratchet up pressure on the government at trial and when making charging decisions.”
