Whole Foods Still Has Options After Trademark Rejection

Jennifer Mikulina said that, following the PTO’s rejection of Whole Foods’ attempt to trademark “World’s Healthiest Grocery Store,” the retailer could file the phrase with the PTO’s Supplemental Register and then start using it to establish acceptance. Ms. Mikulina added that any competitor trying to take over the phrase should ask itself “Do you really want to take on the monster?”
