Todd Solomon said that, since the Supreme Court’s landmark 2013 Windsor ruling “there is no federal definition of marriage, and the federal government defers to the state definitions.” For health benefits plans, he continued, “that deference to the state definition will be done on a ‘state-of-celebration’ approach. That means that anyone legally married anywhere will be treated as legally married everywhere, regardless of where they live and whether that state of residence recognizes same-sex marriage.”
