In this year-end article discussing the U.S. Supreme Court rulings that broke new ground for employee benefits in 2013, Todd Solomon said that the IRS is planning to release further guidance on retroactivity for employee benefits. “So we have yet to see really what they will say,”he said. “I think that you will most likely see this come up in a case for death benefits denied to a same-sex spouse whose marriage pre-dated Windsor who is suing to obtain the retroactive death benefits that they would be owed.”
