Zubik v. Burwell Has Implications for Benefits, Health Care Delivery

Amy Gordon said the Supreme Court’s decision in the Zubik case regarding the ACA contraceptive mandate “should hopefully answer three questions—first, do HHS’s [Health & Human Services] guidelines satisfy the RFRA’s [Religious Freedom Restoration Act’s] test for overriding religious objections; second, do HHS’s guidelines advance a compelling government interest; and third, is the government using the least restrictive means to advance that interest?” Read the full article.
