Overview
Franziska Leubner advises national and international companies, including those in the life sciences, automotive, finance and publishing sectors, on all questions of individual and collective employment law. She represents clients in employment law court proceedings and also advises on data protection, in particular on employee data protection.
Furthermore, Franziska has extensive experience in drafting and negotiating commercial contracts, in particular in the IT sector. In this field, she advises clients both in large transactions and in complex litigation cases before ordinary courts and arbitration tribunals.
During her legal clerkship at the Higher Regional Court of Dresden Franziska worked for a local law firm in Dresden, and a reputable international law firm in Barcelona, Spain.
Results
- Advising Arval Deutschland GmbH on all labor law matters, with focus on regulatory and works agreements for new technical applications as well as the use of internet, e-mail accounts and electronic end devices
- Advising various companies on labor law issues in connection with the Corona crisis, in particular on the employer’s obligation to continue to pay wages, employee protection, dismissals and short-time work
- Advising a leading automotive supplier on short-time work, plant closures, termination agreements and possible layoffs at European and North African locations in the wake of the Corona crisis
- Representation of employers in dismissal protection litigation (e.g. dismissal due to deletion of a hierarchical level, due to closure of a location, due to behavioral reasons, etc.)
- Employee representation in other labor court disputes, especially regarding bonus and salary payments
- Negotiation and drafting of employment, management and consultancy contracts as well as termination agreements
- Advice on and drafting of works agreements, in particular on short-time work or the use of IT and communications equipment in the company
- Advice on the introduction of different working time models and the corresponding drafting of employment contracts
- Consulting on questions of company pension schemes
- Advice and representation of employers in status determination proceedings (to determine social security obligations)
