Overview
Lynn G. Kamarck focuses her practice on regulatory matters and has more than 30 years of experience in international trade matters, with an emphasis on trade remedy proceedings, trade policy, export controls and customs.
Lynn represents clients in international trade proceedings, including antidumping, countervailing duty and safeguards cases, customs penalty proceedings and related litigation. Additionally, Lynn drafts and promotes legislative and regulatory changes on behalf of her clients. Her export control experience includes export compliance company audits, preparation of voluntary disclosures, development of compliance programs, preparation of licenses, ITAR registrations, ITAR General Correspondence and Commodity Jurisdiction requests and advice on sanctions restrictions and the Foreign Corrupt Practices Act.
Lynn served as senior counsel for Antidumping and Countervailing Duty Proceedings in the US Department of Commerce, where she was responsible for the legal sign-off on every antidumping/countervailing duty investigation, review and scope determination issued by the Department. She also represented the Commerce Department in connection with the 1988 Trade Act and was in charge of drafting the implementing regulations for that Act.
Results
Trade Remedies and Trade Policy
- Represents the Government of Canada in the current countervailing duty and antidumping proceedings on softwood lumber from Canada. Representation includes: the current NAFTA proceedings appealing the Commerce Department and International Trade Commission investigation determinations; the WTO appeal of the Commerce Department determination; the Court of International Trade Appeal of the expedited review; and the first and second Commerce Department administrative reviews
- Represented the Government of Mexico in the US countervailing duty investigation of certain fabricated structural steel from Mexico*
- Represented the Government of Indonesia in the Court of International Trade appeals of Commerce Department’s countervailing and antidumping duty determinations on biodiesel; and represented the Government of Indonesia in the underlying investigations*
- Represented the Government of Canada in the countervailing duty investigation involving uncoated groundwood paper from Canada*
- Represented the Government of Canada in various countervailing duty proceedings involving supercalendered paper from Canada, including: the investigation; the NAFTA appeal of the original investigation determination; the expedited review; and the administrative review*
- Assisted a Colombian industry association in preparing the first Colombian countervailing duty petition in a case involving a US industry*
- Represented major German manufacturer in ITC sunset review of light-weight thermal paper which resulted in revocation of the antidumping duty order. Represented that same German manufacturer in one Federal Circuit and several Court of International Trade proceedings relating to Commerce Department antidumping administrative reviews*
- Represented the Mexican government at the Commerce Department in the countervailing duty proceeding on Mexican sugar*
- Represented Canadian importer in high-stakes Customs penalty proceeding*
- Represented a US importer in successful Court of International Trade scope ruling relating to antidumping and countervailing duty orders on aluminum extrusions from the People’s Republic of China*
- Represented foreign producers/foreign trading companies in antidumping duty proceedings before the Commerce Department, the International Trade Commission, and the US Court of International Trade in: stainless steel sheet from Italy; stainless steel plate from Italy; grain oriented electrical steel from Italy; top-of-the-stove stainless steel cooking ware from Korea; Dynamic Random Access Memory Semiconductors from Korea; and uranium from the former Soviet Union*
- Represented foreign producers/government entities in countervailing duty proceedings before the Commerce Department, the International Trade Commission, and the US Court of International Trade in: stainless steel sheet from Italy; stainless steel plate from Italy; grain oriented electrical steel from Italy; and prior softwood lumber from Canada proceeding*
- Represented US downstream manufacturers in steel Section 201 and Section 332 proceedings before the International Trade Commission. Represented US downstream manufacturers in steel Section 201 product exclusion proceedings before the Commerce Department*
- Prepared comments on behalf of coalition of industry representatives in connection with pending trade legislation and Commerce Department and International Trade Commission rulemaking proceedings*
- Organized Congressional hearings on trade-related matters; drafted legislation and met with Congress on behalf of coalition of US manufacturers*
Export Controls
- Conducted export compliance company audits and export review of individual transactions; prepared export compliance manuals; prepared ITAR registrations, licenses and technical assistance agreements; prepared ITAR General Correspondence and Commodity Jurisdiction requests; prepared ITAR and BIS voluntary disclosures; advised on OFAC restrictions; and drafted appropriate export control language for contracts*
