Nicole Wittstein focuses her practice on litigation in the US Supreme Court, federal circuit courts and state appellate courts around the country. She also litigates major motions at the trial level.

Prior to joining McDermott, Nicole served as a law clerk to the Hon. Timothy J. Kelly of the US District Court for the District of Columbia and the Hon. Albert Diaz of the US Court of Appeals for the Fourth Circuit. During law school, Nicole was a member of the Wrongful Convictions Clinic and was an executive editor of the Duke Law Journal.
