Overview
Erik R. Seidlitz is discovery counsel with McDermott Discovery, a division of the Firm. His practice focuses on planning and implementing cost-effective and efficient reviews, frequently employing predictive coding and other forms of technology-assisted review (TAR). Erik develops strategies for large-scale discovery projects in connection with complex litigation, government investigations and cross-border matters. His reviews often involve commercial disputes, patent infringement, the Hart-Scott-Rodino Act (HSR), the Stark Law and the Foreign Corrupt Practices Act (FCPA).
Erik has extensive experience managing the discovery process for government investigations of large, multinational corporations. In one matter, Erik successfully oversaw 10 distinct document reviews involving 60+ custodians and over 10.8 million documents. He leveraged predictive coding and other forms of TAR to reduce one review subset from 3.8 million to one million documents (73 percent reduction). He also developed and implemented complex workflows for handling multilingual documents and managing multiple review teams that comprised a total of 100+ attorneys across three time zones and Southeast Asia.
In another government investigation, he managed the review and production of over 1.7 million documents associated with 50+ custodians, utilizing predictive coding to reduce the potential review set to 675,000 documents (70 percent reduction). Erik developed and implemented workflows specifically tailored for the case that addressed priority custodians and potential hot/key issues for over 360,000 documents.
Erik also developed a plan that was agile enough to complete a review of 376,000 documents in less than three weeks to respond to discovery requests on behalf of a healthcare provider, supervising 65+ attorneys across three time zones to meet client needs.
Prior to joining the Firm, Erik worked as a litigation associate at an international law firm in San Francisco and a mid-size firm in Ohio on various state and federal matters. He represented Fortune 100, 500 and 1000 clients in product liability cases relating to automobiles, construction equipment and medical devices. He also represented attorneys, insurance brokers and agents, and financial industry professionals in professional liability matters.
