New York Tribunal Grants Sales Tax Refund for Securities Agency

Peter Faber represented a securities rating agency in a ruling granting a sales tax refund to the agency. A company that isn’t sure whether to collect sales taxes but pays the tax out of its own pocket can “get a refund of the taxes paid if the ultimate determination is that its services are not taxable,” as long as the company can prove that it didn’t charge customers for the tax, Faber said.
