Franklin Monsour Jr. is a former federal prosecutor and seasoned trail lawyer who focuses his practice on white-collar defense, regulatory enforcement matters, and complex commercial litigation. He also has substantial experience handling False Claims Act (FCA) matters.
Franklin has a proven track record of success. His cases have been featured in national news media, including the well-publicized healthcare fraud case of United States v. Kenia Valle Boza, in which Franklin won a full acquittal after a two-week jury trial. The Department of Justice (DOJ) had alleged that Ms. Valle Boza orchestrated a five-year conspiracy to fraudulently bill up to $50 million in medical claims to Medicare. Franklin and his team put on an extensive defense case, admitting far more evidence than the government and allowing the jury to see what actually occurred. It took the jury only four hours to acquit Ms. Valle Boza of all charges.
In another high-profile case, United States v. Pavandeep Bakhshi, after years-long negotiations, Franklin convinced the DOJ to dismiss its indictment charging Mr. Bakhshi in an alleged $300 million securities fraud conspiracy. Mr. Bakhshi was instead allowed to plea to a single misdemeanor with a $5,000 fine.
Franklin’s civil litigation experience includes FCA defense and extensive motion practice. He has convinced the DOJ to decline intervention in multiple qui tam complaints. Franklin has also secured the dismissal of securities class action complaints and various other claims, including a $30 million claw-back action against an innocent investor caught up in a Ponzi scheme. In addition, he has investigated and filed civil Racketeer Influenced and Corrupt Organizations Act and civil fraud cases, obtaining injunctive relief and damages for clients.
Throughout his practice, Franklin draws on his broad experience as an assistant US attorney for the US Attorney’s Office for the Southern District of Florida. In that role, he prosecuted and tried criminal cases involving fraud, narcotics, and violent crimes, and represented the DOJ in large-scale civil enforcement actions. Franklin was lead counsel in negotiating multiple record settlements in FCA, Anti-Kickback Statute, and civil penalty recoveries. His cases included the then-largest drug diversion recovery and the largest compound pharmacy criminal fraud case to go to trial.
