Are Employer Wellness Programs Under Attack by the EEOC?

Joanna Kerpen discussed new EEOC rules for employee wellness program compliance with the Americans with Disabilities Act (ADA) and the Genetic Information Discrimination Act (GINA). “Employers should first determine whether their wellness programs are subject to the ADA rules and/or the GINA rules,” Ms. Kerpen said, adding that programs subject to either should meet ADA’s prescribed wellness incentive limit and the GINA’s prescribed inducement limit for plans beginning on or after January 1, 2017.
