Ahsan Shaikh said that, because the so-called Planet Blue Federal Circuit case presents some of the most valid software patent claims that might be otherwise rejected under the Supreme Court’s Alice decision, it could “hopefully force the Federal Circuit to look at claims that are more technologically sound than have been previously rejected,” in contrast to previous cases that were “easy ones to knock out.”
